"dont end up like Jimi Hendrix, Picasso, James Dean or Sonny Bono"
All these people died without a Will.
And, according to a Public Trustee spokesman, left their loved ones to fight over their assets guaranteeing a reduction in the inheritance and a future of family strife.
A recent survey commissioned by the public trustee found that 60% of mothers with children under the age of 18 had not made a Will. Almost half of these admitting, they did not know who would be legally and financially responsible for their children if both parents died.
A Will is not just important to the parents. Life can take many unexpected turns, and, if you die without a Will, your estate will be divided - not necessarliy the way you wish - but in accordance with a Government formula.
Too many of us put off making a Will - stop making excuses about a lack of assets, or that you are too busy or not old enough. The fact is, you should write a Will at 18 then update the Will as your circumstances change - like getting married, getting divorced, having a baby, buying a house, starting a business, thinking about retirement or when you inherit.
A Will is a living document. It is meant to be updated as your life changes to make sure that your loved ones are protected from financial upheaval in the event the unthinkable happens to you.
"what can go wrong"
Without a Will your Wishes will not be Recognised
A couple were living together for six months when one partner died with a Will. The Court decided the partner was a legal de facto spouse. This partner received the entire substantial estate, and the parents received nothing.
DIY Wills can be Dangerous
A husband filled in a "do it yourself Will form" intending to leave the whole estate to his wife. While he inserted her name in the section of the form appointing her as executor, he forgot to place her name in that section of the form for nominating a beneficiary - in fact - he left the entire estate to nobody.
Your Assets End up with the Government
An elderly gentleman died without a Will. It could not be established that his birth was ever registered and therefore the next of kin could not be established. His estate worth $180,000 passed to the government.
